ABSTRACT
Establishment – Appointment of Personal Assistants to Members of Legislature Assembly – Delegation of powers – Orders- Issued.

Read the following:
1. G.O.Ms.No.207, GA(SR) Dept., dt. 1.5.2001.
2. G.O.Ms.No.476, GA(SR) Dept., dt. 18.12.2001.

ORDER:
In the GO first read above orders were issued providing all the Members of Legislative Assembly with clerical assistance for attending the work relating to their respective constituency of the MLA. In para 2 of the above GO orders were issued for appointment of personal assistants to the MLA’s on deputation basis from Govt., departments upto UD cadre subject to the following conditions:
i. The candidate for appointment as Personal Assistant shall be as per the choice of the Member of Legislative Assemble concerned out of his Constituency/concerned district establishment.
ii. The appointment of Personal Assistant shall be by drafting deputation from Government Departments up to U.D. cadre.
iii. The appointment of Personal Assistant will be terminated/reverted back to his parent Department whenever the Member of Legislative Assemble concerned vacates his office or at any time the services of Personal Assistant are no longer required by the Member of Legislative Assembly.
iv. The P.A’s are allowed to draw a Fixed Traveling Advance of Rs.1,000/- (Rupees one thousand only) per month.
v. The expenditure towards Salaries and Fixed Traveling Advance of the employee so appointed as Personal Assistant to the Member of Legislative Assembly and issue orders of appointment as Personal Assistant to Member of Legislative Assembly immediately.
2. In the G.O. second read above an amendment was issued substituting para(2) of the GO 1st read above by the following:
i. The candidate for appointment as Personal Assistant shall be as per the choice of the MLA concerned out of his Constituency/concerened District Establishment. In exceptional cases, the persons working in other Districts may also be appointed if the MLA so insists.
ii. The appointment of P.A.’s shall be by drafting personnel including Technical personnel up to the cadre of Senior Assistant working in Government Departments, including the Departments not under the District Administration like Jails, Colleges etc., and also from the Local Bodies and State Government Public Undertakings/Corporations.
iii. The appointment of P.A. will be terminated/reverted to his parent Department whenever the MLA concerned vacates his office or at any time if the services of the PA are no longer required by the concerned MLA
iv. In exceptional cases, where the MLA insists on appointment of a retired Government Employee as his PA such appointment may be done on a consolidated remuneration of Rs.6,000/- p.m., on the analogy of rates allowed to P.A’s (Retd) of M.P’s vide para (2) of G.O.Ms.No.439, G.A.(OP.II) Department dated 27.12.2000.
v. The expenditure towards salaries and fixed T.A. of the employees so appointed as P.A. to the MLA be charged to the Establishment from which he has been drafted.
vi. In respect of the retired employee appointed as P.A., to the MLA the expenditure towards consolidated remuneration shall be met by the District Collector concerned from the Head of the Account of the District Establishment.
vii. The District Collectors shall take necessary steps to obtain requisition from the MLA concerned and issue orders of appointment as PA to MLA duly following the conditions (i) to (vi) mentioned above.
3. Certain representations were received by the Government from MLA’s for relaxation of the conditions/rules mentioned in the G.O.s first and second read above.
4. After careful examination of the matter and in view of the administrative convenience, Government hereby delegate the powers to the Chief Secretary to Government for relaxation of rules/conditions mentioned in the G.O’s first and second read above in the matter of appointment of PA’s to MLA’s.
